1. Overview

These Terms and Conditions ("Terms") govern your use of the website kristinkilburg.com and any services offered by Kristin Kilburg, doing business as Find Your Way with Kristin Kilburg ("Kristin," "I," "me," or "my"). By accessing this website, submitting an inquiry, or booking a session, you agree to be bound by these Terms in full. If you do not agree with any part of these Terms, please do not use this website or book a session.

Kristin Kilburg is a sole proprietor operating in the State of Iowa, United States of America. All services are offered in accordance with applicable Iowa and federal laws.

2. Services Offered

Find Your Way with Kristin Kilburg offers the following services:

Human Design 1:1 Session — A 60-minute virtual session in which Kristin guides clients through the nuances of their individual Human Design chart. Sessions are recorded and provided to the client following the appointment.

Human Design Microdose — A short-form voice recording, approximately 5 minutes in length, delivered via email. This service addresses a single Human Design question or highlights a notable aspect of the client's chart.

Kristin reserves the right to modify, add, or discontinue services at any time without prior notice.

3. Not a Licensed Professional Service

IMPORTANT: Kristin Kilburg is not a licensed therapist, psychologist, psychiatrist, physician, or any other type of licensed mental health or medical professional. The services offered through Find Your Way with Kristin Kilburg are coaching and educational in nature and are not a substitute for professional medical, psychological, psychiatric, or therapeutic advice, diagnosis, or treatment.

Human Design readings and breathwork facilitation are wellness and self-discovery tools. Nothing communicated during a session or through this website should be interpreted as medical advice, a clinical diagnosis, or a treatment plan for any physical or mental health condition.

If you are experiencing a mental health crisis, physical health emergency, or any other serious concern, please contact a licensed professional or call 911 immediately.

4. Breathwork Disclaimer

Kristin Kilburg holds certifications in breathwork facilitation. Breathwork practices, while generally safe, may not be appropriate for all individuals. Certain physical or mental health conditions may be contraindicated for breathwork, including but not limited to:

Cardiovascular conditions, including high blood pressure or history of heart attack
Epilepsy or seizure disorders
History of psychosis, schizophrenia, or bipolar disorder
Pregnancy
Glaucoma or retinal detachment
Recent surgery
Severe anxiety disorders or active trauma

By booking a session that includes breathwork, you confirm that you have consulted with a licensed medical provider if any of the above conditions apply to you, and that you assume full responsibility for your participation. Kristin Kilburg assumes no liability for any adverse physical or psychological effects experienced during or after a breathwork session.

The Human Design System® was founded by Ra Uru Hu. The Human Design System, the Rave BodyGraph™, and the Rave Mandala™ are registered trademarks of Jovian Archive Media Pte. Ltd., which holds exclusive worldwide rights to the Human Design System and all related intellectual property. Kristin Kilburg is an independent practitioner and is not affiliated with, endorsed by, or certified by Jovian Archive Media Pte. Ltd. or the International Human Design School (IHDS) unless otherwise stated.

Human Design is presented as a self-knowledge and decision-making tool. Results and insights shared in sessions are based on the information provided by the client and are not guaranteed to produce any specific outcome.

6. Booking, Payment, and Cancellation Policy

Booking
All sessions are booked through the inquiry form on kristinkilburg.com. A session is not confirmed until Kristin has responded to your inquiry and confirmed availability.

Payment
Payment is due at the time of booking confirmation unless otherwise agreed upon in writing. Accepted payment methods will be communicated at the time of booking. Prices are listed in US Dollars (USD) and are subject to change at any time.

Cancellations and Rescheduling

Clients may cancel or reschedule a session with at least 48 hours notice at no charge. Cancellations made with less than 48 hours notice may result in forfeiture of the session fee. No-shows without prior notice will be charged the full session fee. Kristin reserves the right to reschedule sessions in the event of an emergency or unforeseen circumstance and will provide as much advance notice as possible.

Refunds
All sales are final. Refunds are not issued for completed sessions. If you are dissatisfied with your experience, please contact Kristin directly at kristin@kristinkilburg.com to discuss a resolution.

7. Session Recordings

Human Design 1:1 sessions are recorded for the purpose of providing the client with a copy of their session. By booking a session, you consent to being recorded. Recordings are shared with the client via a secure link and are not shared with any third party without your explicit written consent. Kristin retains no ongoing copies of client recordings beyond the delivery period unless otherwise agreed upon.

8. Confidentiality

Kristin Kilburg respects your privacy and will not share personal information disclosed during sessions with any third party without your written consent, except as required by law. This includes but is not limited to your birth information, personal history, and anything shared during the course of a session.

Please note that sessions conducted via third-party video platforms (such as Zoom or Google Meet) are subject to those platforms' own privacy policies. Kristin is not responsible for the data practices of third-party platforms.

All content on kristinkilburg.com, including but not limited to text, graphics, logos, images, and session materials created by Kristin Kilburg, is the intellectual property of Kristin Kilburg and Find Your Way with Kristin Kilburg. You may not reproduce, distribute, modify, or create derivative works from any content on this website without prior written permission from Kristin Kilburg.

The Human Design System® and related trademarks are the property of Jovian Archive Media Pte. Ltd. and are referenced here for educational and descriptive purposes only.

10. Testimonials and Results Disclaimer

Any testimonials or client stories shared on this website or social media represent individual experiences and are not a guarantee of results. Human Design sessions and breathwork are personal, subjective experiences, and outcomes will vary from person to person. Find Your Way with Kristin Kilburg makes no representations or warranties regarding the effectiveness of any service offered.

11. Limitation of Liability

To the fullest extent permitted by the laws of the State of Iowa and the United States of America, Kristin Kilburg and Find Your Way with Kristin Kilburg shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of this website or participation in any session, including but not limited to:

Emotional distress or psychological discomfort arising from session content
Physical effects experienced during or after breathwork
Decisions made based on information shared in a session
Technical issues with third-party platforms used to deliver virtual sessions

By engaging with Kristin's services, you agree that your sole remedy for dissatisfaction is to discontinue use of the services.

12. Indemnification

You agree to indemnify, defend, and hold harmless Kristin Kilburg and Find Your Way with Kristin Kilburg from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of this website or services, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Iowa, United States of America, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in the State of Iowa, and you hereby consent to the personal jurisdiction of such courts.

In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. If negotiation is unsuccessful, disputes may be submitted to binding arbitration in Iowa in accordance with the rules of the American Arbitration Association, at either party's election, before pursuing litigation.

14. Compliance with Iowa Law

Kristin Kilburg operates in compliance with applicable Iowa state laws governing sole proprietors and service-based businesses. Iowa does not currently require licensure specifically for Human Design practitioners or life coaches. Kristin's breathwork certifications are held through independent certifying bodies. Nothing in these Terms is intended to conflict with applicable Iowa or federal consumer protection laws, and any provision found to be unenforceable under Iowa law shall be modified to the minimum extent necessary to make it enforceable, with the remaining provisions continuing in full force and effect.

15. Children's Privacy

This website and its services are intended for adults aged 18 and older. Kristin Kilburg does not knowingly collect personal information from individuals under the age of 18. If you are under 18, please do not submit any personal information through this website or book a session without parental or guardian consent.
